Terms and Conditions for Explorer

Introduction
These Terms and Conditions ("Terms") govern your use of the Explorer mobile application and the related personal-AI service (the "Service") operated by Billion Labs ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
App Overview
Explorer is a personal AI assistant that delivers curated daily news feeds and provides a conversational chat experience (text and voice). The app uses artificial intelligence — including Google's Gemini family of models via Google Vertex AI — to personalise your experience and respond to your messages.
License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use.
License Restrictions
You agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Service.
- Copy or use the Service for any purpose other than as permitted under this license.
- Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the Service.
- Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of the Service.
- Use the Service to violate any applicable laws or regulations.
Eligibility
- You must be at least 13 years old to use Explorer.
- If you are between 13 and 18, you must have parental consent.
- You must have the legal capacity to enter into these Terms.
- Your use must comply with all applicable laws and regulations.
User Accounts
Account Creation
- Explorer signs you in using anonymous Firebase Authentication; no email, phone number, or social-login profile is required to use the app.
- An anonymous, randomly generated User ID is created and associated with your install. It is your responsibility to keep your device secure, since access to the device gives access to the associated chat history.
- If you optionally provide a phone number to receive your daily feed via WhatsApp, you must provide a number that you own and have the right to use.
Account Responsibilities
- Keep your device and any optional credentials secure and confidential.
- Notify us promptly of any unauthorised access.
- You are responsible for all activity that occurs through your install.
User Content
Content Ownership
You retain all rights to the text and audio content you create using the Service. We do not claim ownership of your messages or recordings.
Data Processing and Storage
To provide and improve the Service (including transcription, AI responses, and personalised recommendations), your messages, voice recordings, and derived artifacts (such as transcripts and AI responses) may be transmitted to and stored on our servers, and shared with the third-party AI provider as described in our Privacy Policy.
Responsible Use
You are solely responsible for:
- Any content you create, upload, or store using the Service.
- Ensuring you have the necessary rights to record and share any audio you submit.
- Complying with all applicable laws regarding audio recording in your jurisdiction.
- Securing your device.
- Reviewing the accuracy and appropriateness of any AI-generated responses, summaries, or news recommendations before relying on them.
Legal Compliance — Recording Consent
IMPORTANT: If you record audio that includes other people's voices, you must comply with all applicable laws regarding recording consent in your jurisdiction. We do not provide legal advice on recording laws.
- One-Party Consent: Some jurisdictions only require one party (you) to consent.
- Two-Party / All-Party Consent: Other jurisdictions require all participants to consent.
- Your Responsibility: You are solely responsible for understanding and complying with your local laws.
Acceptable Use Policy
Permitted Uses
- Send text and voice messages to the Explorer assistant.
- Receive AI-generated responses, summaries, and curated news content for personal use.
- Receive your daily news feed via push notifications or WhatsApp delivery (when enabled).
Prohibited Uses
You may NOT use Explorer to:
- Record or transmit audio without proper legal consent from any individuals captured.
- Violate the privacy rights of others or applicable recording laws.
- Submit confidential, privileged, or otherwise protected information without authorisation.
- Upload malicious content, viruses, or harmful code.
- Attempt to reverse engineer, hack, scrape, or otherwise compromise the Service.
- Use the Service for illegal activities, harassment, hate speech, or to violate others' rights.
- Infringe on intellectual property rights.
- Spam, harass, threaten, or abuse other users or third parties.
- Impersonate others or provide false information to manipulate AI output.
- Use the Service to compete with or replicate our business.
- Submit prompts intended to bypass safety filters or produce harmful content.
Content and Data
Your Content
- You retain ownership of your messages and recordings.
- You grant us a worldwide, non-exclusive, royalty-free license to process, store, transmit, and analyse your content solely as needed to provide the Service.
- You are responsible for the legality and appropriateness of your content.
- You must have rights to all content you submit.
Our Rights
- We may remove content that violates these Terms.
- We may suspend or terminate access for violations.
- We reserve the right to refuse service to anyone.
- We may update or modify the Service at any time.
Payment and Subscriptions
Free Tier
- Basic features are available for free.
- Free-tier usage may be subject to fair-use limitations (such as message rate limits).
- We reserve the right to modify free-tier features.
Premium Features (If Applicable)
- Premium features may require a subscription or one-time payment.
- Payments are processed through the Apple App Store or Google Play.
- Refunds are subject to platform policies.
- Subscription terms (price, period, renewal) will be clearly disclosed at the point of purchase.
Privacy and Data Protection
- Your privacy is important to us.
- Our Privacy Policy explains how we collect, use, and protect your data.
- By using the Service you consent to data processing as described in our Privacy Policy.
- You can request deletion of your data at any time by emailing support@billionlabs.in.
Third-Party AI Services and Data Sharing
Explorer uses Google Vertex AI (Gemini) to power its chat, transcription, and content-personalisation features. By using the chat feature, you acknowledge and agree to the following:
What Data Is Shared
- Your chat messages and stated content preferences shared during conversations are sent to the AI provider for processing.
- Voice recordings you submit are transcribed; the resulting transcript is forwarded to the AI provider along with conversation context.
- If you discuss a specific article from your feed, a summary or excerpt may also be shared for context.
What Data Is NOT Shared
- Your name, phone number, email address, or any other personal identifiers are never shared with the AI provider.
- Your device information, location, IP address, or data from other apps is not shared with the AI provider.
Who Receives the Data
Consent and Withdrawal
- By using the chat feature you consent to the data sharing described above.
- You may withdraw consent at any time by uninstalling the app and contacting support@billionlabs.in to request deletion of any associated data.
- Without consent, the AI chat and personalised feed features will be unavailable.
Data Protection by Third Parties
- Our AI provider is contractually obligated (via the Google Cloud DPA) to provide an equivalent level of data protection as described in our Privacy Policy.
- Data is transmitted over encrypted connections (HTTPS / TLS) and processed through our backend servers, which strip personal identifiers before forwarding.
Service Availability
Uptime
- We strive for high availability but cannot guarantee 100% uptime.
- The Service may be temporarily unavailable for maintenance.
- We will provide reasonable notice for planned maintenance where practical.
Modifications
- We may modify, suspend, or discontinue features at any time.
- We will provide reasonable notice for significant changes when possible.
- Continued use after changes constitutes acceptance.
Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Billion Labs and its licensors. The Service is protected by copyright, trademark, and other laws.
- All trademarks, service marks, and logos are proprietary to Billion Labs.
- The Explorer interface, prompts, recommendation logic, and supporting infrastructure are proprietary.
- You may not use our intellectual property without written permission.
Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
- We do not guarantee the accuracy of AI-generated responses, transcriptions, or news summaries. AI-generated content may be incorrect, incomplete, or out of date.
- You should independently verify any factual, financial, legal, medical, or other consequential information before relying on it.
- We do not guarantee uninterrupted or error-free service.
- We do not provide legal, medical, financial, or professional advice.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, in no event shall Billion Labs, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages — including, without limitation, loss of profits, data, use, goodwill, or other intangible losses — resulting from:
- Your access to, use of, or inability to access or use the Service.
- Any conduct or content of any third party on or through the Service.
- Any content obtained from the Service, including AI-generated content.
- Unauthorised access to, use, or alteration of your transmissions or content.
- Loss of messages or recordings due to device malfunction, app crashes, or other technical issues.
- Inaccuracies in AI-generated transcriptions, summaries, or recommendations.
- Any legal consequences from your use of the recording feature without proper consent.
Our total cumulative liability arising out of or relating to the Service is limited to the greater of (a) the amount you have paid us for the Service in the twelve months preceding the claim, or (b) USD 50.
Indemnification
You agree to indemnify and hold harmless Billion Labs from any claims, damages, or expenses arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of applicable laws.
- Infringement of third-party rights.
- Your content, messages, or recordings.
Termination
- You may stop using the Service at any time by uninstalling the app, and may request deletion of your data by contacting support.
- We may terminate or suspend access immediately, without prior notice or liability, for any reason — including breach of these Terms.
- Upon termination, your right to use the Service will immediately cease and we may delete your data according to our Privacy Policy.
- Outstanding obligations (such as accrued payments and indemnities) will survive termination.
Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice prior to any material changes through:
- In-app notifications.
- Updating the "Last updated" date in these Terms.
By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.
